This Data Privacy Policy describes the policies and procedures on the collection, use and disclosure of your information when using the service, Takso outcomes planning platform (Takso) and describes how Takso protects your privacy rights.
We use your personal data to provide and improve the Takso service. By subscribing to Takso, you and your Organisation agree to the collection and use of information in accordance with this Privacy Policy.
The Takso Data Privacy Policy applies to registered Organisations and their Users of the Takso outcomes planning platform. The Board of Cultural Development Network (CDN) is the responsible governance body for Takso. It aims to lead and maintain the level of data privacy within the scope of risk associated with the relatively low-level of sensitive data including minimal Personal Identifiable Information (PII) that Takso records.
This Data Privacy Policy sits under the Data Management Policy of CDN.
Takso Data Privacy Principles
1. Takso only stores the data it needs to operate the platform.
2. You or your organisation provide a license to CDN to use the recorded data to,
a) generate pre-defined standard non-financial reports from your activities for the Takso library to share with other Takso users, and
b) to generate aggregate reports using de-identified data for benchmarking and sector wide reporting.
3. The Takso data is stored on servers in Australia.
4. The tenancy on the server is protected by encryption and security that meets or exceeds the ISO 27001:2013 standard.
5. There is a separation of data between production (client use), testing (staged), and development (developer).
6. A hierarchy of information classifications & permissions will be pre-set with additional security options managed by the account holder Admin to secure highly sensitive data, where required.
7. Takso aims to be a leading platform in security, privacy, and ethics appropriate to the scale of Takso at the time.
Access to some information classes is only on a ‘need to know’ basis and access is logged by the system to determine who gave permission to whom, to which data, on what dates and times, and for how long.
You and your organisation have some privacy settings within your Takso account that you can implement.
Collecting and Using Data
Personal Identifiable Information While using Takso, we may ask you to provide us with certain personal identifiable information that can be used to contact or identify you.
PII will include the following data:
- Email address
- First name and last name
In addition, for single accounts or organisations:
- Phone number
- ABN/ACN Business Registration
- Address, State/Province, Postal code, City
Your personal data is stored in your Takso Profile in the Service which is linked by a unique User ID.
Your Usage Data
Takso automatically records your usage through your User ID when using the Platform.
Primarily Takso connects your user ID by your unique email address used to login and is stored in your profile. This ID links you to each of the Activity Records that lists you as a member. You are a member of an activity if you create a new activity in your account or accept an invitation by another User to join their activity.
When you access the service by or through a digital device, we may collect certain information automatically, including, but not limited to, the type of digital device you use and its unique ID, the IP address of your device, operating system, type of Internet browser, unique device identifiers and other diagnostic data.
When your usage data is aggregated outside of your account it is in a deidentified format that excludes your PII.
Use of your Personal Identifiable Information
CDN may use PII for the following purposes:
To provide and maintain our Service, including to monitor the usage of our service by its Users.
To manage your Account: to manage your registration as a user of the platform. The Personal Data you provide can give you access to different functionalities of the service that are available to you as a registered user.
For the performance of a contract: the development, compliance and undertaking of the purchase contract for the services or items you have purchased or of any other contract with us through the service.
To contact you: To contact you by email, telephone, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including the security updates, when necessary or reasonable for their implementation.
To provide you with news and general information about other goods, services and events related to Takso unless you have opted not to receive such information.
To manage your requests: To attend and manage your requests to us for support.
For business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganisation, dissolution, or other sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which PII held by us about our service users is among the assets transferred.
For other purposes: We may use your information for other purposes, such as identifying usage trends, determining the effectiveness of our service and to evaluate and improve our products, our services, and your experience.
We may share your Personal Identifiable Information in the following situations:
With service providers: We may share your PII with any future third-party service providers to monitor and analyse the use of our service, and to contact you.
For business transfers: We may share or transfer your PII in connection with, or during negotiations of, any merger, sale of CDN assets, financing, or acquisition of all or a portion of our business to another company.
With Affiliates: We may share your PII with our affiliates, in which case we will require those affiliates to honor this Data Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
With business partners: We may share your PII with our business partners to offer you certain products, services, or promotions unless you have opted not to receive such information.
With other users: when you decide to share PII or otherwise interact with other users while on the Takso platform.
With your consent: We may disclose your Personal Data for any other purpose with your consent.
Transfer of Your Personal Identifiable Information
Your information, including PII, is processed in any place where the parties involved in your activities recorded in Takso are located, including on your premises, by you. It also means that this information may be transferred to, and maintained on, computers located outside of your state or territory but is maintained within your national governmental jurisdiction where the data protection laws may differ than those from your local jurisdiction.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
CDN will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your PII will take place to an organisation unless there are adequate controls in place including the security of your data and other future PII.
Retention of your Personal Data
CDN will retain your PII only for as long as is necessary for the operation of your Account on the Takso platform. We will retain and use your PII to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
CDN will also retain your deidentified Usage Data for internal integrity of the Takso platform where it is necessary to maintain the metrics and the operation of the Platform.
On closing of your User account your Personal Data will be retained for a minimum of 3 months and maximum of 6 months to allow for the removal of your PII from the platform.
Delete Your Personal Identifiable Information
You have the right to delete or request that we assist in deleting the PII that we have collected about you.
You may update or amend information at any time by signing into your Account, if you have one, and visiting the Profile settings section that allows you to manage your PII. You may also contact us to request access to, correct, or delete any PII that you have provided to us.
Please note, however, that we may need to retain certain information when we have a legal obligation or lawful basis to do so.
Deleting Organisation Data
An Organisation can cancel its Takso Account at any time. All activities recorded in Takso by your organisation are maintained as Takso Activity Records and the organisation data is removed and replaced by a randomly generated Organisation ID and all Users registered under that organisation are removed as users and their profiles replaced by a randomly generated user ID. Activity data records are maintained for the integrity of the Takso platform and the underlying data that informs the machine learning of the system. Individual activity records of organisations no longer on the Service are removed from the Takso libraries and exist only as secure data records to maintain the system data.
Disclosure of Your Personal Identifiable Information Business Transactions
If CDN is involved in a merger, acquisition, or asset sale, your PII may be transferred. We will provide notice before your PII is transferred and becomes subject to a different Privacy Policy.
Law enforcement
Under certain circumstances, CDN may be required to disclose your PII if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
Other legal requirements
CDN may disclose your PII in the good faith belief that such action is necessary to:
- Comply with a legal obligation.
- Protect and defend the rights or property of CDN.
- Prevent or investigate possible wrongdoing in connection with the Service.
- Protect the personal safety of users of the service or the public.
- Protect against legal liability.
Security of Your Personal Identifiable Information
The security of your PII is important to us, but there is no method of transmission over the Internet, or method of electronic storage that is 100% secure. While we strive to use technically acceptable means to protect your PII, we cannot guarantee its absolute security.
Children's Privacy As a general practice, our service does not apply to anyone under the age of 13. We do not knowingly collect PII from anyone under the age of 13. If You are a parent or guardian and you are aware that your child has provided us with PII, please contact us. If we become aware that we have collected PII from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.
Your Organisation is not permitted to store PII from anyone under the age of 13 on the Takso Platform. This excludes deidentified evaluation data that could be collected through Takso surveys, and which does not include any personal identifying data.
Changes to this Privacy Policy
We may update the Takso Data Privacy Policy from time to time. We will notify you of any changes by posting the new Data Privacy Policy on this page.
We will let you know by a broadcast notification on our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.
You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
